Breast Implant Diseases and Complications

The U.S. Food & Drug Administration (FDA) recently warned that both silicone and saline breast implants may be associated with anaplastic large cell lymphoma (ALCL), a rare form of cancer. thousands of women who have had their implants for one or two decades now are seeking medical help for symptoms which resemble arthritis, fibromyalgia, scleroderma, connective tissue disorders, and/or immune dysfunction and seem to be associated with their breast implants.

MDL-926 Breast Implant Revised Settlement Closed

The Revised Settlement Program (RSP) permanently closed on 12/15/10. If your disease claim was received by Claims Office before the deadline and you receive a deficiency notice you will have one year from the letter date to correct the deficiency.

 

June 3, 2019 Deadline To Submit Disease Or Expedited Release Claim

If you are registered with the SF-DCT and have not submitted your disease claim, contact our the Dow Corning Breast Implant Helpline for an explanation of the benefits available to you.

Dow Corning/SF-DCT Registration deadline has passed. If you are not sure of your status, you owe it to yourself to call us and find out about your rights within the SF-DCT.

There is no obligation to use our services, and YOU PAY NO FEE UNLESS YOU ARE AWARDED A SETTLEMENT.

Status Of Premium Payments

We do not have an update on when the Finance Committee will make a recommendation to pay the partial Premium Payments to claimants whose payment was stopped because of the ruling by the Court of Appeals for the Sixth Circuit. The Claimant Advisory Committee strongly believes – and has urged the Finance Committee – that these payments should be made immediately. We are hopeful that they will file a recommendation with the Court sometime this year. Once a recommendation is filed, the District Court must still approve it.

There is no update on when the final 50% Premium Payment will be made.

Increased Severity Claims

The Claims Office is now accepting claim filings for “Increased Severity”. You may qualify for an additional settlement if:

Your disease claim was approved in Disease Option 1 (such as ACTD or ANDS disease claims), AND your disease now qualifies for Severity Level A (100% total disability);
Your disease claim was approved in Disease Option 2. You can apply for an Increased Severity Level if you now have a disease or condition that qualifies for a higher level payment.
Time is of the essence! The deadline to file for Increased Severity claims is June 3, 2019.

Dow Settlement Facility -Dow Corning Trust and Your Silicone Breast Implants

On 09/06/01 The Settlement Facility – Dow Corning Trust (the “SF-DCT”) was created to administer silicone gel and implant claims against Dow Corning. You may contact the SF-DCT toll-free at 1-866-874-6099 or (713) 874-6099. SF-DCT and the RSP Claims Office are two separate entities. However, this maize can become extremely confusing very quickly. The Settlement Facility for the Dow Corning Trust (SF-DCT) is processing class 5 claims. Class 7 claims have not been completed yet.

11,000 claimants have been approved for either an Expedited Release Payment of $600.00 or a Disease Cash-Out Offer of $3,000.00. Total payments to date from the Class 7 Fund are $15.5 million. The total fund is $57.5 million NPV.

The Settlement Facility is still reviewing Proof of Manufacturer Claims in Class 7 and is expected to complete all Proof of Manufacturer reviews within the next year.
